  • Part 1: Data processing when visiting our website

For this analysis, the emails sent contain so-called web beacons or tracking pixels, which are one-pixel image files stored on our website. For the evaluations, we link the data collected automatically when you visit the website (see "Collection of personal data when you visit our website" above) and the web beacons with your email address and an individual ID. We use the data obtained in this way to create a user profile in order to tailor the newsletter to your individual interests.     The information is stored for as long as you have subscribed to the newsletter. After you unsubscribe, the data will no longer be used to send the newsletter.

    2d. Forwarding of personal data
    ADG uses the service provider dotdigital, a service of dotdigital EMEA Limited, Evert van de Beekstraat 354, 1118 CZ Schiphol, Netherlands, to send newsletters. The data provided by you when registering for the newsletter will be passed on to dotdigital for the purpose of sending the newsletter.

    3c. Storage period

    The information is stored for as long as the user account exists. The user account can be deleted at any time, for example via the user account settings. Alternatively, you can also send your request to delete the account at any time to service@adg-campus.de by email. Your data will only be stored beyond this if this is necessary within the framework of statutory warranty obligations and comparable obligations; in the case of statutory archiving obligations, deletion will take place after their expiry (end of retention periods under commercial law (6 years) and tax law (10 years)).

    4d. Disclosure of personal data
    We disclose the data to third parties in the context of delivery, payment or in the context of legal permissions and obligations to legal advisors and authorities.     5 Data processing for plugins

The data from participation in courses (content data) will be stored until the course is deleted, unless legal regulations exceptionally permit or require longer storage. You can delete user data and voluntary entries in your user profile yourself at any time.

    4. Disclosure of personal data
    As part of the ADG Learning World, we use the Moodle learning platform on the website https://adg.lms-plattform.de/. Moodle is hosted on the servers of our hosting service provider Mastersolution AG, Postplatz 12, 08523 Plauen, Germany. This service provider necessarily obtains knowledge of your personal data that is processed within the ADG Learning World.   • Part 5: Data processing for job applications

    1 . Types of data processed

    Various data may be processed as part of the application process:
    Name, salutation, title, address, telephone number, fax number, e-mail address, date of birth, details of professional experience, metadata (e.g. IP address or hardware information), CV, certificates, certificate of good conduct, application photo, proof of qualifications, letters of motivation, previous employers and other data that you send us in connection with the application.

    2. Purposes of data processing and legal basis
    The data you provide will be used to process the application, in particular to check the applicant's suitability for vacancies. The legal basis for this is generally Section 26 (1) sentence 1 BDSG.
    The legal basis for transmitted applicant photos and other data not related to the application, which you transmit to us in connection with the application, is your consent in accordance with Art. 6 para. 1 sentence 1 lit. a GDPR. You can withdraw your consent at any time. This does not affect the lawfulness of the processing carried out on the basis of the consent until revocation.

    3. Storage period
    Personal data is stored for the duration of the application process. In the event of a rejection after the end of the application procedure, we store the data for 6 months from the date of sending the rejection letter in order to be able to respond to any queries regarding the application procedure and to be able to defend ourselves in the event of any allegations of a violation of the prohibition of discrimination under the Anti-Discrimination Act. If your application is successful, we will continue to process your data in connection with your employment.

    4. Disclosure of personal data
    We use a tool from PERBILITY GmbH, Starkenfeldstraße 21, 96050 Bamberg, Germany, for applicant management. Based on this tool, your personal data is collected, processed and used by PERBILITY GmbH on our behalf as part of commissioned data processing in accordance with Art. 28 GDPR in accordance with the relevant legal requirements. However, this does not involve any transfer of your personal data to third parties in terms of data protection law. We remain responsible to you under data protection law.

  • Part 6: Data processing in the context of cooperation with business partners

    1. Types of data processed
    We process personal data that we receive from you as part of our business relationship in your capacity as a customer / contractual partner or as a representative / authorized representative / contact person of the company that is our customer / contractual partner.     In addition, we store your personal data as part of your business relationship with us due to legal archiving obligations (legal basis Art. 6 para. 1 sentence 1 lit. c GDPR).

    3 . Storage period
    Your personal data will be processed and stored for as long as is necessary to fulfill our contractual and legal obligations. After fulfillment of the contractual and legal obligations, the personal data is regularly deleted. Exceptions to this are

    - The fulfillment of retention periods under commercial and tax law. The periods for this are between two and ten years.

    - The preservation of evidence within the framework of the applicable statute of limitations. According to §§ 195 ff. of the German Civil Code, these limitation periods can be up to thirty years. The regular limitation period here is three years until the end of the year.

    4. Disclosure of personal data to third parties
    Access to your personal data is granted to those bodies that require it to fulfill contractual and legal obligations.
    Your personal data will be transmitted to the tax office if there is a legal obligation to do so. The legal basis for this is Art. 6 para. 1 sentence 1 lit. c GDPR.
    In addition, we transmit your personal data to tax consultants and auditors commissioned by us on the basis of our legitimate interest in effective and economical accounting management. The legal basis for this is Art. 6 para. 1 sentence 1 lit. f GDPR.
    As part of customer management, ADG uses an ERP system for which the service provider is responsible.

    When using MOA, the following personal data about you is processed if you use MOA to communicate with us (e.g. in a video conference):
    Personal data about you may be processed when you use MOA. This is the case, for example, if the content of a communication with MOA also contains personal data about you. This data may include, in particular, your master data and contact data, data on transactions, contracts, other processes and their content. In addition, usage data such as your IP address or access data may be collected and processed.

    We also use MOA as part of our internal corporate communications to exchange information between employees and to manage and store documents and data. Such documents and data may also contain personal data relating to you. For example, documents and data may be stored on Microsoft's servers for further processing, which also contain personal data about you (for example, in the case of an offer created for you and transmitted within the company using Microsoft Teams).     2. Purposes of data processing and legal basis
    Data processing in connection with the use of the MOA is carried out for the purposes of document storage and management, calendar management, sending emails, spreadsheets and presentations, exchanging documents, content and information, and for participation in audio and video conferences. Insofar as the MOA is used in connection with the establishment, implementation or execution of contractual relationships or pre-contractual measures or is necessary for the implementation of pre-contractual measures, the legal basis is Art. 6 para. 1 sentence 1 lit. b GDPR.

    Insofar as your personal data is also processed in the context of using MOA, this is done for the purpose of pursuing our legitimate interests (legal basis Art. 6 para. 1 sentence 1 lit. f GDPR). Our legitimate interest lies in the use of MOA to make internal company communication channels more efficient and simplify them.

    Microsoft also processes metadata and authentication data on our behalf, which is used for security purposes and service optimization (legal basis Art. 6 para. 1 sentence 1 lit. f GDPR). The legitimate interest here lies in the use of the MOA to make internal company data and documentation management more efficient and to simplify communication channels.

    3. Storage period
    We delete or anonymize your personal data as soon as it is no longer required for the purposes for which we collected or used it in accordance with the above purposes. As a rule, we store your personal data for the duration of the contractual relationship with you, unless we are entitled or obliged to store it for a longer period.

    4. Disclosure of personal data
    Microsoft necessarily obtains knowledge of the above-mentioned data insofar as this is provided for within the framework of the order processing relationship.

    5. Data processing outside the European Union
    In principle, data processing outside the European Union (EU) does not take place. However, we cannot rule out the possibility that data may be routed via internet servers located outside the EU.     Data processing by the ADG social media channels serves the external presentation of ADG, communication and interaction with interested parties and the processing of inquiries made via social media channels.     3. Storage period

    5. Data processing outside the European Union

  • Right to information

    The data subject has the right to object, on grounds relating to his or her particular situation, at any time to processing of personal data concerning him or her. We will then no longer process the personal data unless we can demonstrate compelling legitimate grounds for the processing which override the interests, rights and freedoms of the data subject or for the establishment, exercise or defense of legal claims (Art. 21 GDPR). The revocation only takes effect in the future. Processing of personal data prior to the revocation is not affected by this.

  • Right to data portability

    In accordance with Art. 20 GDPR, the data subject has the right to receive the personal data that you have provided to us in a structured, commonly used and machine-readable format or to request that it be transmitted to another controller.

  • Right to lodge a complaint with a supervisory authority

    Without prejudice to any other administrative or judicial remedy, every data subject has the right to lodge a complaint with a supervisory authority if the data subject considers that the processing of personal data relating to him or her infringes the GDPR (Art. 77 GDPR).
